Introduction

This website www.homevents.in and/or any part thereof (“Website”) is owned Eventelix India Private Limited (“Eventelix”). For the purposes of these Terms Of Use, the expression “User” shall mean any person (including a Registered User) who accesses or uses the Website / Mobile app and ‘Registered User’ means a User who has registered himself with the Website/Mobile App for availing the services provided therein. Eventelix hereby grants the User an non-exclusive, limited permission to use the Website/Mobile APP subject to the unconditional acceptance of all these terms and conditions (called “Terms” or “Terms and Conditions”) governing use of this Website and the User hereby agrees to familiarize himself/herself with the Terms and Conditions and other terms and guidelines found throughout this Website and abide by them. If the User is dissatisfied with the Website or any portion thereof, or with any of these Terms and Conditions, the sole and exclusive remedy is to discontinue using this Website /Mobile Application.

The Website/Mobile application is deemed to be used by the User when it is accessed by the User by any means and/or when it is loaded and/or continues to be loaded in the temporary or permanent memory of the User’s computer or a similar system or in the internet browser thereof. Eventelix own records of the use of the Website & Mobile application and transactions concluded therein, maintained through computer systems or otherwise shall be accepted as conclusive and binding for all purposes. The User’s use of this Website may be terminated at any time by Eventelix at the sole and absolute discretion of Eventelix, without any reason or notice required to be given.

The User understands and agrees that Eventelix is a NETWORK SERVICE PROVIDER and an aggregator and that the Website merely provides as platform to its Registered Users and viewing facilities to persons browsing / visiting the Website. All information posted therein are posted by Registered event partners of Eventelix and are third party user generated contents. generated contents and shall not have any liability for such content.

Eligibility

Use of the Website is available only to persons eligible to enter into legally binding contracts under the Indian Contract Act, 1872. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including persons of unsound minds, minors, un-discharged insolvents etc. are not eligible to use the Website. If the User is a minor i.e. under the age of 18 years, the User shall not register as a member of the Website. If, a minor wishes to use the Website, such use shall only be made by the User’s legal guardians or parents who can register themselves as Registered Users on the Website. Eventelix reserves the right to terminate any User’s membership and refuse to provide the User with access to the Website if it is brought to Eventelix notice or if it is discovered that the User is under the age of 18 years.

Users Account and Registration Obligations

All activities on the Website require the User to be a Registered User. Eventelix asks for some personal information when the User creates Registered User Account , including the User’s email address and a password, which is used to protect the Registered Users account from unauthorized access.

If a User uses the Website/Mobile application the User shall be responsible for maintaining the confidentiality of the User’s ID and Password and for restricting access to the User’s computer, computer system and computer network, and the User shall be responsible for all activities that occur under the User’s ID and Password.

The User agrees, inter alia, to: 

• Provide true, accurate, current and complete information about the User as prompted by Eventelix registration form (such information being the "Registration Data").
• Maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If the User provides any information that is untrue, inaccurate, not current or incomplete or Eventelix has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the User Agreement, Evenelix has the right to indefinitely suspend or terminate the User’s registration with the Website /Mobile App and refuse to provide the User with access to the Website.

Unless specifically agreed to by Evenelix in writing, no content from this Website & Mobile app may be used, reproduced, transmitted, distributed or otherwise exploited in any way.

The User agrees not to submit , use and /or cause the storage into the Website, of any information that :

• is defamatory, abusive, harassing, threatening, or an invasion of a right of privacy of another person; (b) is bigoted, hateful, or racially or otherwise offensive; (c) is violent, vulgar, obscene, pornographic or otherwise sexually explicit; or (d) otherwise harms any person or entity;
• is illegal or encourages or advocates illegal activity or the discussion of illegal activities with the intent to commit them, including a posting or submission that is, or represents an attempt to engage in, child pornography, stalking, sexual assault, fraud, trafficking in obscene or stolen material, drug dealing and/or drug abuse, harassment, theft, or conspiracy to commit any criminal activity;
• infringes or violates any right of a third party including: (a) copyright, patent, trademark, trade secret or other proprietary or contractual rights; (b) right of privacy (specifically, the User must not distribute another person's personal information of any kind without their express permission) or publicity; or (c) any confidentiality obligation;
• is commercial, business-related or advertises or offers to sell any products, services or otherwise (whether or not for profit), or solicits others (including solicitations for contributions or donations);
• contains a virus or other harmful component, or otherwise tampers with, impairs or damages this Website or any connected network, or otherwise interferes with any person or entity's use or enjoyment of this Website; or
• is antisocial, disruptive, or destructive, including "flaming," "spamming," "flooding," "trolling," and "griefing" as those terms are commonly understood and used on the Internet.

The User understands and accepts the fact that Evenelix cannot and does not assure the User that other users will comply with these Terms or any other provisions of these Terms of Use, and, as between the User and Eventelix the User hereby assumes all risk of harm or injury resulting from any such lack of compliance.

The User shall not use the Website for commercial purposes (without the prior written authorization of Eventelix) or in any way that is unlawful, or harms Eventelix or any other person or entity, as determined in Eventelix sole discretion. All commercial uses without Eventelix express approval including any of the following actions are prohibited:

• sale of access to the Website or its related services (such as the ‘Homevents App’ ) on another website;
• use of the Website or its related services (such as the ‘Homevents App’), for the primary purpose of gaining advertising or subscription revenue;
• the sale of advertising, on the the Website or any third-party website, targeted to the content of specific User Submissions or the Website content;
• Any use of the Website or its related services (such as the ‘Homevents App’) that Eventelix finds, in its sole discretion, to use the Website's resources or user submissions with the effect of competing with or displacing the market for the Website content, or its user submissions.
• Any use of the Website not expressly authorized in writing.

The User understands and acknowledges that the User may be exposed to User Submissions that are inaccurate, offensive, indecent, or objectionable, and the User agrees to waive, and hereby do waive, any legal or equitable rights or remedies the User has or may have against Eventelix or the Website with respect thereto, and agrees to indemnify and hold Eventelix its Owners/Operators, affiliates, and/or licensors, harmless to the fullest extent allowed by law regarding all matters related to the use of the site by the User.

The User should never use another user’s account without permission. The User is solely responsible for the activity that occurs on the User’s account, and the User must keep the Users account password secure. The User must notify the Website immediately in the event of any breach in security or unauthorized use of the Users account. Eventelix assumes no responsibility for the completeness and/ or availability of information posted/submitted by Registered Users on the Website.

Although Evenelix will not be liable for the User’s losses caused by any unauthorized use of the Users account, the User may be liable for the losses of Eventelix or others due to such unauthorized use of the Users Account.

The User agrees not to alter or modify any part of the Website, including but not limited to the ‘Homevents App’ or any of its related technologies. Further, the User shall not:

• Reverse engineer, decompile, disassemble, copy, reproduce, distribute, modify, transmit, perform, publish or create derivative works from or in any way exploit any part of the Website violation of the Terms and Conditions or the laws of any country.
• Create a database in electronic or structured manual form by systematically downloading and storing the entire Website or part thereof except such information as relates or concerns the User.
• Cache or permit caching by any person.
• Do any act that violates Eventelix intellectual property rights in the Website.
• Engage in any fraudulent, abusive or illegal activity, including but not limited to any communication or solicitation designed or intended to fraudulently obtain the password or any private information of any use.
• Use the Website to violate the security of any computer or computer network, crack passwords or security encryption codes, transfer or store illegal material including threatening or obscene material or engage in any kind of illegal activity.
• Run mail list or any form of auto-responder, or spam on the Website or any processes that are run or are activated while the User is not logged on or engage in any virus attack or denial of service attach or engage in any activity designed and/or intended to interfere with the working of Website for any duration of time.

The User agrees not to use or launch any automated system, including without limitation, "robots," "spiders," or "offline readers," that accesses the Website in a manner that sends more request messages to the Website servers in a given period of time than a human can reasonably produce in the same period by using a conventional on-line web browser.

Notwithstanding the foregoing, Eventelix grants the operators of public search engines permission to use spiders to copy materials from the Website for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of the materials, but not caches or archives of such materials. Eventelix reserves the right to revoke these exceptions either generally or in specific cases. The User agrees not to collect or harvest any personally identifiable information, including account names, from the Website, nor to use the communication systems provided by the Website (e.g. comments, email) for any commercial solicitation purposes. The User agrees not to solicit, for commercial purposes, any other users of the Website. 

In the use of the Website, the User shall otherwise comply with the terms and conditions of these Terms of User and all applicable local, national, and international laws and regulations.

Eventelix reserves the right to discontinue any aspect of the Website at any time.

Account Termination :

• Eventelix will terminate a User's access to the Website if, under appropriate circumstances the User is determined to be an infringer.
• Eventelix reserves the right to decide whether Content or a User Submission is appropriate and complies with these Terms of Service for violations other than copyright infringement, such as, but not limited to, pornography, obscene or defamatory material.
• Eventelix may remove any User Submissions and/or terminate a User's access for uploading any material in violation of these Terms of Service at any time, without prior notice and at its sole discretion.
• Eventelix reserves the right to deny, in its sole discretion, any User access to this Website or any portion thereof without notice.

Disclaimer of warranties

This Website service is provided on an "as is" and "as available" basis. Except as warranted in these terms, Eventelix expressly disclaims all warranties of any kind, whether express or implied or statutory, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose, data accuracy & completeness in the Website or any part thereof or any transactions entered into through the Website, and any warranties relating to viruses and non-infringement in the Website or any transactions entered into through the Website. Eventelix makes no representations or warranties, either express or implied that the use of the Website will not infringe any patent, copyright or other right of any third party. No advice or information, whether oral or written, obtained by the User through, or from, the Website shall create any warranty not expressly stated herein.

Eventelix makes no warranty that the Website will meet the User's requirements, or that the Website will be uninterrupted, timely, secure, or error free; nor does Eventelix make any warranty as to the results that may be obtained from the use of the Website or as to the accuracy or reliability of the information/material on the Website.

Limitation of liability

The User agrees that Eventelix shall not be liable for any direct, indirect, incidental, special or consequential damages, (including, but not limited to, damages caused by personal injury, loss of profits, use, data or other intangible, business interruption, loss of privacy, or any other pecuniary loss) to the User or any third party resulting from the (i) errors, mistakes, or inaccuracies of content, (ii) Personal injury or property damage, of any nature whatsoever, resulting from the User’s access to and use of the Website, (iii) any unauthorized access to or use of the Website and secure servers, And/or any and all personal information and/or financial information stored therein, (iv) any interruption or cessation of transmission to or from the Website, (v) any bugs, viruses, trojan horses, or the like, which may be transmitted to or through our Website by any third party, and/or (vi) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use by the User of any content posted, emailed, transmitted, or otherwise made available on the Website, whether based on warranty, contract, tort, or any other law, and whether or not Eventelix is advised of the possibility of such damages. The Registered User’s specifically acknowledges that Eventelix is only providing a platform at its absolute discretion to share certain information and shall not be liable for :-

• User submissions or the defamatory, offensive, or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with the User.
• The use or the inability to use the services provided by the Website
• The delivery or the inability to deliver the services provided by the Website.
• The performance or the inability to perform the services provided by the Website
• Any costs or consequences resulting from the above acts/omissions or resulting from the access to, or alteration of User's transmissions or data. 

The User further agrees that Eventelix shall not be liable to the User or any third party for any damages arising from error, interruption, suspension or termination of, or in, the Website, including but not limited to direct, indirect, incidental, special, consequential or exemplary damages, whether such interruption, suspension or termination was justified or not, negligent or intentional, inadvertent or advertent.

The User's use of each such other website is subject to the terms of use and other terms and guidelines, if any, contained within each such other website. In the event that any of the terms contained herein conflict with the terms of use or other terms and guidelines contained within any such website, then the terms of use and other terms and guidelines for such other website shall prevail. The linked websites are not under the control of Eventelix and Eventelix is not responsible for the contents of any linked web site or any link contained in a linked web site, or any changes or updates to such web sites. Eventelix is providing these links to the User only as a convenience, and the inclusion of any link does not imply endorsement by Eventelix of the other website.

The User agrees that Eventelix is not responsible for the accuracy, completeness or availability of information, content and materials found on other websites that link to or from the Website. Eventelix cannot ensure that the User will be satisfied with any services that the User purchases from a third-party/ other website that links to or from the Website or third-party information, content or materials contained on this Website (including, without limitation, User-Generated Content contained in Public Forums).

Eventelix does not endorse any of the merchandise, nor has Eventelix taken any steps to confirm the accuracy, completeness or reliability of, any information, content or materials contained on this Website or on any other third-party website. Eventelix does not make any representations or warranties as to the security of any information, content or materials (including, without limitation, credit card and other personal information) the User might be requested to give to any third party. The User hereby irrevocably waives any claims against Eventelix with respect to information, content and materials contained on our Websites (including, without limitation, User-Generated Content), on third party websites, and any information, content and materials Users provide to such third party websites (including, without limitation, credit card and other personal information). General

Eventelix reserves the absolute discretion to modify the Website or to amend/supplement any of these Terms at any time, which amendments / supplements shall automatically become binding on the User , as soon as the amendment or supplement is made to the Terms and is published on the Website.

Eventelix may sub-contract and employ any affiliate to carry out any of its obligations under these Terms and Conditions. Eventelix may transfer or assign its rights and obligations under this contract to any third party without requiring any consent of the Registered Users or any other Users.

The Website, these Terms and the User’s use of the Website is governed solely by Indian law, without regard to conflict of law principles in other jurisdictions. Use of this Website is unauthorized and prohibited in any jurisdiction that does not give effect to all provisions of these Terms including without limitation, this paragraph. Eventelix accepts no liability whatsoever, direct or indirect for non-compliance by Eventelix with the laws of any country other than that of the Republic of India.
